Member's Rights
Membership rights are established by BuilderBrokerNetwork.com to users entirely and are granted specifically to the registering member only. No associate, business partner, affiliate or any individual directly or indirectly related to Member of a competing real estate information shall gain access to any of the Password Protected Areas of the BuilderBrokerNetwork.com web site without expressed written permission from BuilderBrokerNetwork.com. Members shall not be permitted to share their individual logon information with other members, non-members or users. BuilderBrokerNetwork.com has the right to refuse website to any member or individual, or corporation or group (and all persons associated or affiliated with mentioned group) that refuses to abide by the terms and conditions herein, displayed on the BuilderBrokerNetwork.com website, or abuses their rights related to the BuilderBrokerNetwork.com website. Upon registration, which is free, Member becomes a Basic Member. A Basic Member may search the BuilderBrokerNetwork.com with limited access the listings and wants and needs postings. In order to view all the available results for a given search, the Member must upgrade to a Premium Membership. A Basic Member may also list properties on the website for a fee.
By completing BuilderBrokerNetwork.com's registration process requiring that you provide current, complete, and accurate information as prompted by the registration process on the Website, which you represent is accurate and complete in all respects and that you are over age eighteen (18), and paying any and all amounts due on or before their due dates.
BuilderBrokerNetwork.com uses email communications methods as a vital and primary communication channel with its members. As a registered user, Members hereby acknowledge and grant BuilderBrokerNetwork.com the permission to communicate with members via email (as well as other communication channel such as phone and fax) for any purposes BuilderBrokerNetwork.com determines to be relevant including, but not limited to, system messages, product updates, website announcements and other marketing messages. BuilderBrokerNetwork.com will use best efforts to honor Member's request to opt out of marketing messages, but under no circumstances will BuilderBrokerNetwork.com have any liability for sending any email to its registered users/members.
Submitting Data & Information for Property Listings
Members or Non-Members are prohibited from posting or transmitting to or from this website any unlawful material that would violate any applicable law. All users agree to only post, send, and receive messages and material that are related to the real estate industry. Members and all users warrant that any images provided to BuilderBrokerNetwork.com are the intellectual property of the user. BuilderBrokerNetwork.com cannot be held responsible in the event any third party makes a claim that images were the intellectual property of third party and used without authorization. BuilderBrokerNetwork.com owns the design layout and listing solutions for its members and will be the exclusive distributor of the members' flyer. All content included on this site, such as text, graphics, logos, buttons, images, and software not supplied by the members is the property of BuilderBrokerNetwork.com.
Material submitted for publication becomes the property of BuilderBrokerNetwork.com and may be edited for publication purposes. Material may be used in other media at BuilderBrokerNetwork.com's discretion. BuilderBrokerNetwork.com may send information and updates occasionally that is relevant to Commercial Real Estate.
Member fully agrees not to input or submit any property descriptions, photos, financial information, personal contact or other information contained in each Property's data to BuilderBrokerNetwork.com unless the Member has received all necessary rights and authorizations, including but clearly not limited to or from the photographer and/or copyright owner of any photographs, to publish and advertise the Property on the Member's website or on BuilderBrokerNetwork.com's website. Specifically, Member will not submit a photograph if Member received the photograph from a third party information provider under the terms of a license that does not allow posting of such photograph on the BuilderBrokerNetwork.com website. PKWeb Ventures, Inc. may, in its sole discretion but without any obligation to search for such, remove Properties that are alleged to have been submitted in violation of this provision. In addition, PKWeb Ventures, Inc. may require additional evidence of compliance with this provision from Members who are alleged to have submitted Properties or other information in violation of this Agreement. PKWeb Ventures, Inc. may, in its sole discretion, terminate the accounts of, and refuse website to, any Member who repeatedly or knowingly violates this Terms of Use. Member agrees to maintain accurate contact information (specifically, a valid phone number and email address) in order to submit and maintain active property listings on the BuilderBrokerNetwork.com website. Additionally, the Member agrees to allow the Property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the Member's website or the BuilderBrokerNetwork.com website. PKWeb Ventures, Inc. shall have the sole authority to choose the manner in which any Property will be searched, displayed, accessed, downloaded, copied, and otherwise used on the BuilderBrokerNetwork.com website and Company shall have the right to modify the property listing in the exercise of its rights under this Agreement. The Member (a) represents and warrants that all Properties and associated information provided by the Member will be accurate; (b) agrees that the Member will not permit the posting of a property on the BuilderBrokerNetwork.com system under a name other than the named licensed real estate agents that have been engaged by the property owner to market the property under the terms of a duly executed listing agreement with the owner; (c) agrees to administer the Properties provided by the Member and maintain their accuracy at all times. PKWeb Ventures, Inc. reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Properties posted on the Member's website or on the BuilderBrokerNetwork.com website. PKWeb Ventures, Inc. accepts no responsibility for checking the accuracy of reports or data files submitted by the Member. While PKWeb Ventures, Inc. shall take all reasonable efforts for data backup and business resumption, the Member will be solely responsible for retaining back-up copies of all information, photographs and other materials it provides to BuilderBrokerNetwork.com. BuilderBrokerNetwork.com may add digital watermarks to certain parts of your property listing, including photographs. We add these digital watermarks to protect against the copying or further distribution of your photographs without your permission.
Premium Memberships
A Member who purchases a Premium Membership are granted by BuilderBrokerNetwork.com to individuals exclusively and are granted specifically to the subscribing Member only. Premium Membership rights can not be transferred, shared or assigned to anyone other than the itself without the express written permission of BuilderBrokerNetwork.com. Premium Membership privileges are subject to change from time to time and may be subject to eCampaign services, wants & needs postings, property listing, and property searching limitations.
Premium Members have the right to utilize other BuilderBrokerNetwork.com services or products for a discount of up to a price of fifty percent (50%) less than the then-prevailing list price for these products or websites. In order to be eligible for any discount pricing your Premium Membership must be current and active, in good standing, and not have any outstanding payment charges.
Payment Terms & Conditions
Member fully agrees to pay for all services and products ordered through the BuilderBrokerNetwork.com website or via the BuilderBrokerNetwork.com sales team using the payment method indicated, and shall provide BuilderBrokerNetwork.com express authorization to charge said fees to the Member's payment provider at time of purchase or renewal. If member refuses to pay or is late with its payment, BuilderBrokerNetwork.com may immediately cease to provide any and all services to the member. The fees paid for annual memberships are non-refundable, regardless of whether the membership is terminated prior to the end of the then-current annual billing period. .
Memberships will automatically renew using the Member's current account information supplied by Member unless Member cancels their membership on the BuilderBrokerNetwork.com in writing or email communciations three (3) days prior to the renewal date to cancel such membership. All cancellation requests will be processed within five (5) business days. Once the cancellation is processed, a confirmation email will be sent via the member's email account on record with BuilderBrokerNetwork.com.
The Member must notify BuilderBrokerNetwork.com about any billing problems or discrepancies within 30 days after charges first appear on Member's statement. If it is not brought to BuilderBrokerNetwork.com's attention within 30 days, Member agrees to waive their right under this clause.
Any attorney fees, court costs, or other costs incurred in collection of delinquent undisputed amounts shall be the responsibility of and paid for by Member.
Unsolicited Email (Spam)
BuilderBrokerNetwork.com prohibits the use of our email service and system for sending unsolicited email. Members may not use the Contact Broker on the website or other email websites that BuilderBrokerNetwork.com offers to send spam (i.e. unsolicited commercial email) or otherwise send content that would violate these Terms and Use. BuilderBrokerNetwork.com reserves the right to rescind the privileges of any member or company that breaches these terms.
Limitation of Liability, Fully Harmless and Complete Indemnification
IN NO EVENT SHALL BUILDERBROKERNETWORK.COM BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, LOSS OF BUSINESS, LOSS OF USE OR OF DATA, OR INTERRUPTION OF BUSINESS) ARISING OUT OF THIS TERMS OF USE. Member's exclusive remedy, and BuilderBrokerNetwork.com's entire liability under this Terms of Use shall be a refund to Member of the annual membership fees totaling one year paid to BuilderBrokerNetwork.com hereunder, and in no event will BuilderBrokerNetwork.com's liability for any reason exceed such fee. BuilderBrokerNetwork.com (and its officers, directors, employees and agents) shall not be liable for any damages whatsoever arising from Member's use of the websites service and products and Member shall indemnify BuilderBrokerNetwork.com (and BuilderBrokerNetwork.com's officers, directors, employees and agents), and hold each of them fully harmless from and against any and all costs, damages or losses by any of them (including, without limitation, reasonable attorneys' fees) as a result of a claim by any person other than Member arising from Member's use or application of the Websites or the services and products.
